These Terms and Conditions of Sale (hereinafter, the “Terms and Conditions of Sale”) govern the purchase by users (hereinafter, also “Users” or “Customers”) of products (the “Products”) and/or Entry Tickets (the “Tickets”) or the booking of apartments (the “Apartments”) online through the websites shop.terreborromeo.it and terreborromeo.it, both owned by SAG S.r.l, with registered office in Milan, Via Borromei 1/A, VAT number and Milan Register of Companies registration number 07040700150 (“SAG”).
The purchase of Products and/or Tickets through the aforementioned websites constitutes a remote contract pursuant to Italian Legislative Decree no. 206 of 2005 (“Consumer Code”), as amended by Legislative Decree 21/2014, and governed by Italian Legislative Decree no. 70 of 2003 on e-commerce. Before proceeding with the purchase, Users shall read these Terms and Condition of Sale carefully and accept them. Acceptance of the Terms and Conditions of Sale is indicated by ticking the appropriate box during the process of purchasing the Products or Ticket or booking the apartment (i.e. during checkout) and entails the User’s commitment to comply with the provisions herein. Without such acceptance, it will not be possible to complete any purchase on the Site.
These Terms and Conditions of Sale apply to all orders for Products and Tickets placed through the Websites. SAG reserves the right to change these Terms and Conditions of Sale at any time, it being understood that, in the event of changes, the conditions in force at the time of transmission of the order by the User shall apply.
These Terms and Conditions of Sale do not govern the sale of products and/or services by parties other than SAG, not even those that may be present on the Site via links, banners or other hypertext links. SAG is not responsible for the provision of services and/or sale of products by such parties. SAG does not conduct any control and/or monitoring of the websites that can be consulted via such links, and it is therefore not responsible for the contents of such sites, nor for any errors and/or omissions and/or violations of the law on their part.
DEFINITIONS
The following definitions shall apply to these Terms and Conditions of Sale (without distinction between the use of the singular or the plural):
a) SAG: company that operates in the cultural sector, specifically in the management and administrative, fiscal and tax coordination of sites, monuments, and real estate of historic, artistic, cultural, wildlife, and sports interest in the areas of Lago Maggiore and Mottarone. The sites managed include the Palace and Gardens of Isola Bella, the Palace and Gardens of Isola Madre, Pallavicino Park and Villa, the Rocca di Angera castle, the Castles of Cannero, various retail establishments on Isola Bella (Fope, I Capricci, Kway, Il Vicolo, L’Emporio) and Stresa (Info Point Stresa), various holiday homes on Isola Bella and in Stresa, several restaurants on Isola Bella (Albergo Ristorante Delfino, Bistrò il Fornello, La Piadineria, Ape Goloso and Ape Gelato) and Isola Madre (La Piratera, Ape Gelato, Ape Salato), and sports and recreational activities on Mottarone, such as the ski lifts, the Mottarone Adventure Park and two food & beverage establishments (Rifugio Genziana and Bar Stazione);
c) Consumer: the Customer acting for purposes unrelated to any entrepreneurial, commercial, craftsmanship or professional activity carried out;
d) Contract: the contract regarding Tickets, Products or Apartments offered on the Site to the Customer, whether the latter is a Consumer or a Professional, in an online sales transaction without the physical presence of SAG or the Customer, and only through the use of online communication tools until conclusion of the contract. This also includes the “sales contract” by which the professional transfers or undertakes to transfer ownership of goods to the consumer and the consumer pays the price, provided that it is concluded remotely;
e) Parties: SAG s.r.l. and the Customer;
g) Tickets: the entry/season ticket that entitles the end customer to access the place for which it was issued during the period and/or on the day specified. Tickets shall be considered the physical means to benefit from the actual service, which is the subject of the Contract.
Section A - Purchase of Tickets
A.1. Purchase on the site
A.1.1 To purchase a Ticket on the Site, Customers must first fill in the appropriate registration form, entering all the required personal data, followed by an order form in electronic format that will be sent directly to SAG, following the guided procedure. Customers may purchase several Tickets during the course of a single purchase procedure for additional persons as well, including minors, by providing the obligatory information required for each of them.
A.1.2 Before sending the form, Customers will be asked to confirm the accuracy of the data entered and may promptly correct them in the event of errors; moreover, if the system detects errors related to the omission of mandatory fields in the form, it will automatically flag them. By filling in the form, Customers implicitly declares that they have the necessary powers to act in the name and on behalf of the persons for whom they are purchasing the Entry Ticket, and that they have also obtained consent to perform the aforesaid acts from the legal guardians of minors who may be the beneficiaries of such purchase.
A.1.3 Once the accuracy of the data entered has been confirmed, Customers may proceed with payment in accordance with the procedures set forth in Art. A.2 below.
A.1.4 SAG will send the Customer an e-mail summarising the purchase made, i.e. the order confirmation containing: the key information of the Ticket, a detailed indication of the price, and the payment method selected; the same e-mail will contain a link to download the purchased Ticket.
A.1.5 The order form shall be received by SAG only for the purpose of correct completion of the purchase procedure; however, it shall not be saved in any of its databases, unless the customer has given their consent to data processing for marketing purposes during the purchase process. In this case, SAG stores information on the products purchased, quantity and price paid.
A.1.7 The purchase of Tickets on the Site is permitted both to Users who are Consumers as well as Users who are not. Individuals purchasing Tickets must be at least 18 years old. In any case, if the User decides to purchase a Ticket for a beneficiary who is a minor and for whom they are not legal guardian, said User, by finalising said purchase, accepts and declares to release and exonerate the SAG company from any and all civil and criminal liability that may arise from or be in any way connected to said purchase.
A.2 Ticket payment methods
A.2.1 SAG accepts the following forms of payment: Credit card: Mastercard, Maestro, Visa, Visa Pay, Amex.
A.2.2 The total amount due will be debited upon transmission of the order at the conclusion of the payment procedure.
A.2.3 At the end of the transaction, the Customer will receive an e-mail confirming successful payment, with a link to download the purchased Ticket.
A.2.4 If payment authorisation is denied, SAG will not be able to send the Tickets and shall not be liable for any delay or non-delivery.
A.3. Ticket acquisition method
A.3.1 Tickets that have been purchased will be delivered to the Customer upon payment of the costs due; if the order amount exceeds €77.47, an additional charge will be applied (€2.00 stamp duty). At the end of the payment, an order confirmation page will appear and the customer will simultaneously receive an e-mail summarising the purchase made at the e-mail address provided, containing a link to download the purchased entry/season ticket.
A.3.2 Once downloaded, the Customer may also save the Ticket on their mobile device.
A.3.3 Note that Tickets may not be duplicated under any circumstance or in any manner, and printed copies of tickets that have already been validated at the turnstiles will not be accepted.
A.4. Additional services
A.4.1 By purchasing a Ticket, the Customer is also entitled to special discounts and advantages, as well as to participate in competitions and prize events if organised by SAG. The additional services linked to the purchase of the Ticket will be indicated during the Ticket purchase procedure.
A.5. Price and validity of tickets
A.5.1 Unless otherwise stated in the order confirmation, the price specified is the price set by SAG, published on the Site and coinciding with the price stated on the Ticket itself.
A.5.2 Flexible-time or open-date Tickets are valid only for the current season, as per the date of payment issued on the order confirmation. Fixed-date Tickets may only be used for the day selected and in accordance with the terms and conditions stated on the Ticket. Once purchased, the date of fixed-date Tickets cannot be changed and the ticket cannot be refunded, even in the event of a Customer error in selecting the date.
A.4.4 In the event of any changes in costs or other elements or circumstances affecting the price, SAG reserves the right to modify the price of the Tickets. Any change in the price of Tickets shall not affect the Tickets already purchased by Users.
A.4.5 SAG turnstile and security staff, upon entry to the subject location or service of the Ticket, may refuse the Ticket if it proves to be duplicated or stolen, upon special verification through the Ticket authenticity verification systems.
A.4.6 The access control system will authorise entry for each Customer of only one Ticket, equivalent to a single entry ticket issued. Any photocopies and/or fraud resulting from the improper use of the same will be prosecuted in accordance with the law and not attributable to SAG. Under no circumstances will SAG allow access via any duplicate and/or previously used Tickets.
A.4.7 SAG is not obliged to replace any Tickets that have been misplaced or lost, that are deteriorated or damaged or that have been stolen or are illegible as a result of not being intact.
A.4.8 Tickets must be kept and presented in the event of a check.
A.4.9 With specific reference to season tickets, holders may be asked to verify their identity by presenting a valid identification document that includes a photograph.
A.5. Liability and prohibitions
A.5.2 Tickets may not be resold for consideration in the context of professional performance of commercial activities, even if not organised as a company, without the express consent of SAG and, in any case, if SAG specifically prohibits the transfer of ownership on the basis of registration principles or for promotions aimed at specific target audiences or markets.
A.5.2 Furthermore, Tickets may not be used as the reward of prize events, whether or not they fall within the scope of Presidential Decree 430/2001, nor of other prize or promotional initiatives (such as competitions or lotteries), except in the case of prior written authorisation issued by SAG.
A.5.2.4 Customers are obliged to consult the Site for the calendars and opening/closing times scheduled for each location that they intend to visit. In any case, SAG reserves the right to change the dates and opening/closing times of the various locations, as well as of any events scheduled within the same during the duration of the Contract. SAG also reserves the right to close, remove or modify, at any time, parts, works, etc. within the locations, for maintenance, safety and/or other operational reasons or as a result of the organisation of special events to be held at said locations. The Customer acknowledges and expressly agrees that they shall not be entitled to any reimbursement of sums paid if one or more locations are not accessible during the term of the Contract, for any reason whatsoever, i.e. if one or more works, etc. within the locations are closed for maintenance, security and/or other operational reasons or as a result of the organisation of special events to be held at any of the locations. If the Ticket is a fixed-date Ticket and the relevant location to which the Ticket refers is unavailable, SAG shall provide the Customer with a new Ticket, upon the Customer’s request, up to the day indicated on the fixed-date Ticket.
A.6. Exclusion of the right of withdrawal
A.6.1 SAG wishes to inform Customers that, since it is a supply of services concerning leisure and cultural activities, with a specific date or period indicated on the Ticket itself, the right of withdrawal pursuant to Art. 59, I, lett. n) of Legislative Decree 206/05 and subsequent amendments and additions does not apply to the Contract, pursuant to Art. 52 of the same.
A.6.2 Customers may therefore not exercise any right of withdrawal with regard to the purchase of any Ticket.
Section B - Purchase of Products
B.1. Purchase procedure
B.1.1 Selection of Products
Users shall choose the Product(s) they wish to purchase and add it(them) to their shopping cart. They may then proceed with their order (“Order”).
B.1.2. Sending the order
Once the User has selected the preferred delivery and payment options from those available, they must expressly accept the Terms and Conditions of Sale of the Products and confirm that they have read the information concerning the processing of personal data and, as applicable, consent to particular types of processing.
Once this has been done, the User must send the Order by selecting the appropriate button and, consequently, pay the price of the Products according to the method selected, as this is an “order with obligation to pay”. The Purchase Order thus transmitted to SAG by the User shall constitute a single purchase proposal for each of the Products listed therein; therefore, if some of the Products selected by the User are not available, the purchase may be completed only for the Products available.
B.1.3 Submission and acceptance of the Order.
Upon receipt of the Order, SAG will automatically send a message of acceptance of the Order to the e-mail address provided by the User (“Order Confirmation”). The Order Confirmation does not constitute acceptance of the Order. By sending the Order Confirmation, SAG only confirms that it has received the Order transmitted by the User and that it has subjected it to a verification process. The purpose of this verification is to check conformity of the Order with these Terms and Conditions of Sale.
B.1.4. Conclusion of the Contract of sale.
The Contract may be considered as concluded only when SAG, through e-mail message to the address provided by the User, expressly informs the User of acceptance of the Order and, at the same time, provides information regarding the shipment and expected delivery date of the Products (“Shipment Confirmation”). In the event of an Order for several Products with different shipping times/methods, SAG may send more than one Shipment Confirmation.
B.1.5. Non-acceptance
In the event of total or partial non-acceptance of the Order, SAG shall notify the User without delay via e-mail. Solely by way of example, SAG reserves the right not to accept the sale of all or part of the Products indicated in the Order in the following cases: (i) total or partial unavailability of the Products; (ii) receipt of Orders that appear anomalous in relation to the quantity of the Products purchased or to the frequency of the purchases made or in any case in contrast with the provisions of the Terms and Conditions, including the provisions relating to the registration on the Website; (iii) Order concerning Products published at an incorrect price, for any reason whatsoever (systems error, human error, etc.); (iv) Order transmitted by a User (a) with whom a dispute is already underway; (b) who has previously violated the conditions of use of the Website; (c) who has been involved in fraud of any kind and, in particular, in credit card payment fraud; or (d) who has provided false, incomplete or in any case inaccurate identification data or who has not promptly sent to SAG the documents that SAG may have requested in order to ascertain the identity of the User, or who has sent invalid documents.
B.2. Availability
B.2.1. The Products offered on the Site are limited in number and may be sold at discounted prices. Therefore, the Product ordered could no longer be available after the purchase order has been registered. In any case of unavailability of the ordered Product, the user will be promptly informed by e-mail and the purchase order will be cancelled. If payment has already been made, SAG shall reimburse the user within a period of thirty days from the day after the order was placed.
B.3. Payment method
B.3.1. Details of the payment methods accepted by SAG for payment of the price are outlined in the purchase procedure and made available to the user upon confirmation of the Order. The payment methods accepted by SAG are: Credit card, Paypal.
B.3.2. The payment service is managed by a third-party payment provider (which differs depending on the payment method selected by the User). During the course of the payment procedure, additional payment authentication may be required by the card issuer or banking institution (i.e. “Verified by Visa”, “MasterCard Secure Code”, PayPal authenticator). Under no circumstance shall SAG be held liable for payment errors through the third-party payment service that occur due to a lack of connection or for direct and/or indirect damages that the User suffers for any reason or cause whatsoever as a result and consequence of suspensions or interruptions in the operation of the banking institution’s website (including possible cyber attacks). If, for any reason whatsoever, it is not possible to debit the amount due, the sale process shall be automatically cancelled and the Order will not be finalised, without any amount being charged to the User and without any liability on the part of SAG.
B.3.3. If the User authorises the PayPal function allowing future purchases, this Website will store an identification code linked to the User's PayPal account. This will allow the Website to automatically process payments for future purchases or payment of periodic instalments of a previous purchase. This authorisation may be revoked at any time by contacting SAG or by changing your personal PayPal settings.
B.4. Prices
B.4.1. All prices of the Products indicated on the website or in the catalogues are inclusive of VAT. They do not include any additional and different taxes, levies or duties laid down by the relevant applicable legislation, such as those provided for imports.
In these cases, the User must then clear customs and pay any taxes and duties that may be due in the importing country.
B.5 Shipment and delivery of the goods
B.5.1. The purchased Products will be delivered to the User by shipment to the delivery address indicated by said User in the Order.
B.5.2. For each order placed on the Website, SAG will issue an accompanying invoice for the material shipped. For issuance of the fiscal document, the information provided by the User at the time of the Order shall prevail. No changes can be made to the fiscal document after it has been issued.
B.5.3. Except for promotions specified on the Website, the shipping costs indicated on the Website are borne by the User and are clearly indicated when placing the Order.
B.5.4. The estimated timeframe for fulfilment of the Order and delivery of the Products to the User is indicated on the Website.
B.5.5. In any case, SAG shall not handle shipment of the subject goods Order, which shall instead be carried out by a professional carrier (express courier) as indicated on the Website, and no responsibility may be attributed to SAG in the event of delay on the part of the courier or in relation to any other event or circumstance concerning shipment of the goods by the courier.
B.5.6. Upon delivery of the goods by the courier, Users must check that:
B.5.7. Any damage to the packaging, the presence of seals altered in any way, and/or discrepancies with respect to the consignee's details or documentation must be immediately indicated in writing on the courier's delivery receipt.
B.5.8 The Parties acknowledge that Orders consisting of several Products may be the subject of several shipments.
B.6. Right of withdrawal
B.6.1. Exercise
Users may withdraw from the Contract, without penalty and without having to state a reason, within 14 (fourteen) calendar days, starting from the day on which the Product was received. Once this period has expired, the return will no longer be accepted.
To exercise the right of withdrawal, Users must send a written communication to SAG exclusively by means of the specific Withdrawal Form present on the Website and accessible through the following link, entering the order number and the e-mail address through which the purchase was made, as well as the Product and/or Products to be returned. However, Users are free to express their intention to withdraw from the Contract in any other suitable form by contacting SAG directly at the contact details on the Website and in these Terms and Conditions. To comply with the period within which the right must be exercised, Users must send the withdrawal declaration prior to expiry of the withdrawal period.
B.6.2. Deadline
Following exercising of the right of withdrawal, Users are obliged to return the goods to SAG within 14 (fourteen) days from the date of notification of withdrawal to SAG. The goods must be returned to SAG complete with all accessories, instruction manuals, and everything originally delivered to the User, as well as packed in their original packaging. A copy of the electronic order receipt must be attached to the returned product. The costs of returning the goods to SAG shall be borne by the User.
B.6.3. Effects of withdrawal
SAG shall reimburse all payments received including, if made, those for delivery costs to Users who have correctly exercised their right of withdrawal. However, any additional costs resulting from the choice of a particular delivery method other than the least expensive standard delivery offered by SAG shall remain the responsibility of the User. SAG shall refund the amount to the User only after the return of the Products for which the User has exercised the right of withdrawal and only after having verified the integrity of the same. The refund will be provided in the same manner in which the User made the payment. In the event of payment by credit card, the refund will be made to the same card used for the purchase. SAG has no power to intervene with regard to the timing of the refund, which is at the discretion of the bank of reference.
B.6.4. Shipment
Unless SAG has offered to collect the Products, Users are obliged to return them to SAG by sending them to SAG s.r.l., Strada Statale Sempione Nord nr. 81, 28838 Stresa - Verbania (Italy), within 14 days from the day they communicated their intention to withdraw from the Contract. The deadline is met if delivery of the goods to the courier or other authorised person occurs before the expiry of the 14-day period described above. The refund may be withheld until receipt of the Products or until the User has provided proof of return. Users are liable for any decrease in the value of the goods resulting from use of the goods other than what is necessary to establish their nature, characteristics, and functioning. Note that the return shipping costs following withdrawal shall be borne by the User.
B.6.6. Conditions
The right of withdrawal is subject to the following conditions:
B.6.7. Exceptions
Without prejudice to the other cases of exclusion of the right of withdrawal provided for in the Consumer Code, the right of withdrawal is excluded in the following cases:

Section C - Booking of Holiday Homes
C.1. Online booking procedure
C.1.1. The procedure to book a holiday home online is as follows:
(i) Select the check-in and check-out dates, the number of guests (specifying adults and children), and the type of holiday home;
(ii) Check the booking details and total cost on the Website and enter the details of the individual making the booking;
(iii) Select the payment method and proceed with immediate payment of the deposit;
(iv) Accept the specific terms and conditions of the reservation indicated on the summary page (e.g. cancellation terms, check-in/check-out times where applicable);
(v) Confirm the booking by clicking on the appropriate button and send the booking to SAG.
C.1.2- After confirming the booking and paying the deposit indicated in the service summary, the Customer will receive an e-mail message at the address indicated, containing a summary of their order, the booking number, and the service specifications and cancellation terms.
N.B.
It is mandatory to check the booking summary before payment, ensuring that all data (dates, times, names of guests, addresses) are correct. Should even minor inaccuracies (e.g. a mistake in writing names) be detected due to an error in data entry on the part of the customer, with the customer bearing full responsibility for the error, SAG must be contacted immediately. In any case of reversal, cancellation, non-receipt of the price of the booked service, or if there are reasonable grounds to assume that the booking is fraudulent, SAG reserves the right to cancel the booking or demand the countervalue. Should it prove impossible to make contact with the customer, SAG may not confirm or may cancel the booking without incurring any liability.
C.2. Conclusion of the Contract
C.2.1. The Contract is completed upon acceptance of the booking by SAG and receipt of the deposit payment by the Customer. The specific conditions stated in each booking and in the booking summary will also apply to the Contract. Upon successful completion of said payment, the reservation will be definitively confirmed. Otherwise, the Customer will not be entitled to keep the reservation.
C.3. Exclusion of the right of withdrawal
C.3.1. SAG wishes to inform Customers that, since it is a supply of services concerning leisure and cultural activities, with a specific date or period indicated on the Booking itself, the right of withdrawal pursuant to Art. 59, I, lett. n) of Legislative Decree 206/05 and subsequent amendments and additions does not apply to the Contract, pursuant to Art. 52 of the same.
C.4. Cancellation or modification of the booking
C.4.1. Any cancellation and/or modification of the reservation is indicated and reported within the booking summary that each User receives upon completion of the reservation.
General Clauses
Causes for Refusal or Cancellation of Orders
SAG reserves the right to refuse or cancel orders from: (i) a User with whom it has an ongoing legal dispute; (ii) a User who has previously violated these Terms and Conditions of Sale and/or the regulations of the reference locations managed by SAG and communicated to the Customer at the time of access to the location; (iii) a User who has been involved in fraud of any kind and, in particular, fraud relating to credit card payments, or ticket scalping; (iv) Users who have provided false, invented, fictitious, incomplete or in any case inaccurate identification details and/or in any way not corresponding to the truth or referring to third parties, or who have not sent the documents requested by SAG as part of the payment procedure or who have sent invalid documents to SAG.
Suspension of the service
SAG reserves the right to temporarily suspend, without prior notice, provision of the Site’s services for the time strictly necessary for the technical interventions necessary and/or appropriate to improve the quality of the services and for ordinary and extraordinary maintenance of the Site, its contents and functionalities.
SAG may, at any time, interrupt the provision of the Site's services in the event of justified security reasons or breaches of confidentiality, in which case the user may be informed by the Site itself.
Processing of personal data
Personal data shall be protected and processed in accordance with the Privacy Policy available at https://terreborromeo.it/privacy-policy.
Amendments to the Terms and Conditions of Sale
SAG reserves the right to modify the Terms and Conditions of Sale at any time to meet commercial and market needs, to improve the Site’s offer, or to comply with new regulations or industry best practices. Any amendments to the Terms and Conditions of Sale shall be effective as of the time of publication on the Site and shall apply to Contracts stipulated after such publication.
Customer service contacts and complaints
All communications regarding these Terms and Conditions of Sale of Products must be sent to the addresses indicated in the “Contact Us” section of the Site. SAG will make every effort to respond to complaints within 10 (ten) working days from receipt of the same or, in any case, as soon as possible.
Applicable law and Court of Jurisdiction
These Terms and Conditions of Sale and all disputes regarding their execution, interpretation and validity are subject to Italian law and to the exclusive jurisdiction of the Court of Milan.
If the Customer can be defined as a Consumer, the territorial jurisdiction shall mandatorily lie with the court of the place of residence or domicile of the Consumer, if located in the national territory. This is without prejudice to the Consumer's right to bring action before a judge other than one of the “consumer’s jurisdiction” pursuant to Article 66-bis of the Consumer Code, with territorial jurisdiction according to one of the criteria set forth in Articles 18, 19 and 20 of the Italian Code of Criminal Procedure, as well as the possibility, where the requirements are met, to promote an out-of-court settlement of disputes relative to consumer relations through recourse to the procedures set forth in Part V, Title II-bis of the Consumer Code.
Property rights
The logos, trademarks and distinctive signs, the website and all contents, information and materials present on the website pertaining to the properties, activities managed by SAG, as well as the rights on the same (including the copyright), are the exclusive property of SAG and may not be reproduced, in whole or in part, transferred (by either electronic or conventional means), modified, linked or in any other way used for any purpose without prior written consent by SAG s.r.l.
